THE LEGAL PROTECTION OF ANIMALS IN THE FACE OF ANIMAL ABUSE CRIMES IN THE BRAZILIAN LEGAL SYSTEM

This study examines the evolution of legal protection for animals in Brazil, focusing on the repression of animal cruelty crimes. The research is justified by the growing social awareness of animal welfare and the need for a robust legal framework that reflects this paradigm shift. The main objective is to analyze the effectiveness of current regulations and existing gaps in animal protection. The methodology employed is bibliographic in nature, exploring relevant legislation, legal doctrine, and jurisprudence. Results indicate legislative progress, especially with Law No. 14.064/2020, which stiffens penalties for cruelty to dogs and cats, but also reveal challenges in practical application and in the perception of animals as subjects of rights. It concludes that, although the Brazilian legal system shows progress, the effectiveness of animal protection demands greater enforcement, education, and a legal interpretation that transcends a utilitarian view.
