CIRCUMSCRIPTION AND PERTINENCE: A CRITICAL ANALYSIS OF MATERIAL IMMUNITY IN THE MUNICIPAL LEGISLATIVE POWER

The objective of this paper is to analyze the limits of parliamentary material immunity granted to Municipal Councilors under Article 29, item VIII, of the Brazilian Federal Constitution. This inviolability, sometimes invoked to support offensive or discriminatory statements, is examined in light of the limits expressly provided for in the constitutional text and in the case law of the higher courts. Based on a hypothetical-deductive approach, through legislative, doctrinal and case law research, the study concludes that, although the material immunity of Municipal Councilors applies to the exercise of the mandate throughout the territorial circumscription of the Municipality, there must be a connection between the statements and the parliamentary activity, even when such statements are made within the premises of the Legislative House.
