THE VICES OF LEGAL TRANSACTIONS IN BRAZILIAN LAW: REFLECTIONS FROM AN ARISTOTELIAN PERSPECTIVE

This article explores the intrinsic relationship between Aristotelian philosophy of voluntariness and defects in the manifestation of will in contemporary Brazilian civil law. Drawing from Aristotle's "Nicomachean Ethics," the study delves into the conceptualization of voluntary, involuntary, and "non-voluntary" acts, highlighting the importance of this distinction for attributing ethical and moral responsibility. Subsequently, the paper analyzes the relevance of voluntariness in the current legal landscape, especially within a capitalist context of intense contractual relationships, emphasizing how freedom and consciousness in the formation of will are pillars for the validity of legal transactions. The discussion then turns to the defects of consent provided in the Brazilian Civil Code of 2002 (error, fraud, duress, state of peril, and lesion), examining their characteristics and implications for the annulment of contracts. Finally, the article establishes a dialectic dialogue between Aristotelian theory and Brazilian civil legislation, drawing parallels and connections that demonstrate how ancient philosophical foundations can enrich the understanding of modern legal institutions, particularly regarding the protection of autonomy of will in private relations.
