MODELO DE EFICIENCIA JUDICIAL: RELACIÓN CON DIMENSIONES FISCAL, PRESUPUESTARIA, CONTENCIOSA Y RECURSOS PROCESALES

Resumen

El Poder Judicial debe ser independiente y eficiente. Esta investigación propuso y validó un modelo para medir la eficiencia operativa judicial en los Tribunales de Justicia Estatales de Brasil, utilizando el Análisis Envolvente de Datos (DEA), y analizó la influencia de factores como las dimensiones fiscal, presupuestaria y de litigiosidad, además de las tasas de recurrencia interna y externa, sobre el puntaje de eficiencia de los Tribunales de Justicia. La investigación adopta un DEA orientado a resultados con rendimientos variables a escala para calcular el puntaje de eficiencia, seguido de una regresión TOBIT para identificar sus determinantes. Los resultados indican que, tras la validación metodológica, el modelo más adecuado para medir la eficiencia en el contexto brasileño es aquel que separa las salidas en materias penales y no penales, capturando las diferencias tecnológicas del procedimiento procesal. Los resultados también mostraron que la dimensión fiscal contribuye positivamente a la mejora de la eficiencia judicial, mientras que la presupuestaria tiene un efecto negativo en el puntaje. Además, la litigiosidad influye negativamente en la eficiencia, mientras que las tasas de recurrencia interna y externa no presentaron significancia estadística. Estos hallazgos aportan evidencia empírica inédita para la gestión pública del Poder Judicial, indicando que la salud fiscal es más relevante para su eficiencia que el mero volumen presupuestario del Tribunal.
