CIVIL LIABILITY FOR MORAL DAMAGES ARISING FROM OFFENSIVE COMMENTS ON SOCIAL MEDIA: LIMITS BETWEEN FREEDOM OF EXPRESSION AND PERSONALITY RIGHTS

This article analyzes civil liability for moral damages arising from offensive comments on social media, focusing on the limits between freedom of expression and personality rights in Brazilian law. The objective is to examine the foundations of civil liability, understand the conflict between fundamental rights, and analyze its application in the digital environment. A deductive method with a qualitative approach is adopted, based on bibliographic and documentary research. The findings indicate that freedom of expression is not absolute and must respect personality rights. It is concluded that civil liability is essential to protect human dignity and ensure balance in digital relations.
