THE RIGHT TO ORAL HEALTH IN PRIMARY CARE IN IMPERATRIZ (MA): A LEGAL-EPIDEMIOLOGICAL ANALYSIS (2018-2025)

This study investigates the (in)effectiveness of the right to oral health in primary care in Imperatriz (MA) from the perspective of Constitutional Law and Health Dentistry. The research problem questions to what extent the provision of these services, between 2018 and 2025, guarantees the level of the existential minimum in relation to the state duty of Art. 196 of CRFB/88. The general objective is to evaluate the compliance of the municipal network with the constitutional parameters of universality and efficiency, based on epidemiological indicators. The methodology is based on the deductive method, with an empirical-dogmatic approach and quantitative survey of secondary data extracted from the e-SUS system (SISAB). The results reveal a critical average population coverage of less than 6%, with an abrupt drop in productivity in 2024 (3.77%) followed by recovery in 2025 (6.28%), in addition to the predominance of curative procedures (extractions) over preventive ones. In the discussion, these findings are compared with the STF's understanding in Theme 698 of General Repercussion, characterizing an unjustified state omission due to instability in the continuity of the service. It is concluded that the Existential Minimum and the Efficiency Principle are vulnerable by municipal management, and intervention via the Conduct Adjustment Term (TAC) is imperative to ensure regularity and universality of access to oral health.
