THE EXPANSION OF SYMBOLIC CRIMINAL LAW AND ITS IMPACTS ON THE LEGITIMACY OF THE BRAZILIAN CRIMINAL JUSTICE SYSTEM

This study analyzes the phenomenon of symbolic criminal law and its impacts on the legitimacy and effectiveness of the Brazilian criminal justice system. It is based on the understanding that the expansion of criminal law, driven by social demands and penal populism, has contributed to the deviation from its traditional function of protecting legal interests. In this context, the study examines the administrativization of criminal law, the weakening of constitutional guarantees, and the expansion of state punitive power. Furthermore, it addresses the consequences of this expansion, such as mass incarceration, the emergence of parallel penal systems, and institutional discredit. It concludes that the symbolic use of criminal law undermines its legitimacy and does not contribute to its effectiveness, highlighting the need to reaffirm its constitutional limits and its role as a last resort.
