RELIGION AND GENDER IN CONSTITUTIONAL TEXTS: ITALY, ARGENTINA, PALESTINE AND ISRAEL

Abstract

This article shows the national identity (demographic geopolitics) in the legal texts of different countries. The analysis of the information exposed aims to develop methods to measure xenophobic, religious and gender discrimination in the civil laws of different countries. The research field selected is: 1) The Constitution of the Italian Republic; 2) The Constitution of the Argentine Nation; 3) The Basic Laws of the Palestinian Authority; 4) The Basic Laws for the State of Israel. The study of constitutional laws allows us to ponder about the legal hermeneutics of each country, identifying their nation, state and governmental system that determine the application of its laws. The final thoughts aim to analyze the overlap of social doctrines, civil values and clerical foundations, which, in defense of the interests of political authorities and under the aegis of public order and morality, overlap human rights and democratic principles.
