ENVIRONMENT IN DISPUTE: PUBLIC POLICIES, SOCIO-ENVIRONMENTAL IMPACTS AND THE JUDICIALIZATION OF THE BR-319 LICENSING IN 2026

The general objective is to analyze the socio-environmental impacts and legal-institutional impasses related to the licensing of the BR-319 highway in the current year. This study adopts a qualitative approach of a bibliographic and documentary nature, critically analyzing technical reports, judicial decisions, scientific articles, and recent news about the progress of the licensing and construction. The research seeks not only to describe the facts but also to interpret the power dynamics and arguments at play in this complex and multidirectional process. The main references that underpin this research include studies by authors such as Fearnside (2022; 2024), Ferrante and Piccinini (2024), who highlight the serious environmental impacts and violations of indigenous rights associated with the reconstruction of the BR-319 highway, while official documents such as that of SEDECTI (2024) emphasize the potential for sustainable regional development of the project. Authors such as Pinheiro and Nascimento (2025) address the economic and legal dimensions of the project, and Chagas et al. (2023) analyze the effects of the highway's implementation from a technical-environmental perspective. Finally, it is concluded that the BR-319 symbolizes a civilizational challenge: how to reconcile the need for logistical integration with the urgency of environmental conservation and the guarantee of the rights of local populations. The case demonstrates that, without a consistent systemic, ethical, and technical vision, large infrastructure projects in the Amazon will continue to be a source of conflict and uncertainty, instead of vectors of truly sustainable and inclusive development.
