HEINOUS CRIME AND ANIMAL PROTECTION: A CRITICAL ANALYSIS OF BRAZILIAN CRIMINAL POLICY

The criminal protection of non-human animals in Brazil constitutes a topic of growing legal relevance, especially after the enactment of Law No. 14.064/2020, which qualified the mistreatment of dogs and cats with a prison sentence. This study analyzes the legal-constitutional and criminal-policy viability of including animal cruelty crimes in the list of heinous crimes established by Law No. 8.072/1990. The research adopts a qualitative approach, of a bibliographic and documentary nature, with analysis of normative texts, legal doctrine, and specialized scientific literature. The results indicate that animal sentience provides the constitutional basis for elevating these conducts to the category of heinous crimes, but that the effectiveness of the criminal norm depends, in a determining way, on the structuring of veterinary forensic expertise and the operational capacity of the criminal prosecution system. The study concludes that the heinous classification, in isolation, does not guarantee real protection for animals; it needs to be accompanied by investment in forensic infrastructure, standardization of protocols, and specialized training of legal practitioners. The comparative analysis with other legal systems reinforces that the effectiveness of animal criminal protection depends less on the normative label and more on the institutional capacity to investigate, prove, and punish the conducts.
