LAW NO. 11.108/2005 (COMPANION LAW) AS AN EFFECTIVE INSTRUMENT TO COMBAT OBSTETRIC VIOLENCE

This study analyzes the effectiveness of Law No. 11.108/2005 in protecting the rights of pregnant women and parturients in addressing obstetric violence in Brazil. It is based on the problem related to the gap between the guarantees provided in the legal system and their practical implementation in Brazilian maternity hospitals. The research aims to understand the contribution of this legislation to the promotion of more humanized and respectful obstetric care. To this end, a qualitative approach is adopted, based on bibliographic and documentary research, involving the analysis of legislation, legal doctrine, and institutional data on childbirth in the country. The results demonstrate that, despite normative advances, practices of obstetric violence still persist, marked by unnecessary interventions, lack of consent, and a high number of cesarean sections. It is concluded that Law No. 11.108/2005 represents an important advancement, but its effectiveness is still limited by structural and cultural factors, requiring the strengthening of public policies and the humanization of childbirth.
